Responsible person duties under the Aged Care Act 2024

Who is personally on the hook under the Act, and what discharging the duty actually looks like.

The Act attaches direct, non-delegable duties to providers under s 179, and to responsible persons (board directors and executive decision-makers) under s 180, backed by a civil-penalty regime. And "responsible person" reaches past the boardroom: s 12 also names the registered nurse responsible for the overall management of nursing services, so directors of nursing and senior clinical leaders are captured too. What due diligence actually requires of a director as a responsible person, and what that status means in practice for directors of nursing and senior clinical leaders, from suitability assessment to the clinical evidence the board depends on, plus the questions, evidence and cadence that show the duty is being discharged in your board pack and quality committee.

Purchase terms

  • What you're buying: streaming access to the named briefing episode for 12 months from its release date, plus the PDF briefing paper, which is yours to keep. Annual pass: the same, for every briefing released during your 12-month pass.
  • Access window: each briefing's streaming access runs for 12 months from release; the end date is shown at checkout. After it ends the video is no longer available; your PDF remains yours.
  • Currency: each briefing is current as at its release date, shown on the episode and at checkout. Regulation changes over time, so we release a new briefing at least monthly; a briefing reflects the position at its release and is decision-support, not a substitute for current professional advice.
  • Delivery: for a briefing that has already been released, your access link arrives by email shortly after payment. For a briefing you buy ahead of its release — or with the annual pass — we email your link when that briefing goes live. If your link hasn't arrived when you'd expect it, email info@hg-au.com and we'll fix it.
  • Refunds: if the briefing doesn't play, we'll fix it or refund you. Nothing in these terms limits your rights under the Australian Consumer Law.
  • Licence: one licence per purchase — access is for you and your leadership team within one organisation only. Please don't republish the briefing or share the link outside your organisation.
  • Privacy: we collect your name and email to deliver your purchase, send your receipt, and let you know when a new briefing is released. We won't add you to marketing lists unless you opt in.
  • Prices are in Australian dollars.
